1. Acceptance of Terms
By accessing or using INSTROC ("the Service"), operated by INSTROC, Sweden, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
INSTROC is an AI-powered application builder that allows users to create, design, and publish web applications. These Terms govern your use of our platform at instroc.com, including all features, tools, and services we provide.
2. Eligibility
You must be at least 16 years of age to use INSTROC. By creating an account, you represent and warrant that you meet this age requirement. If you are between 16 and 18 years of age, you confirm that you have your parent or guardian's consent to use the Service.
3. Account Registration
To use certain features of INSTROC, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
4. Acceptable Use
You agree to use INSTROC only for lawful purposes. You may not:
- Create applications that contain illegal, harmful, or offensive content
- Infringe upon intellectual property rights of others
- Distribute malware, viruses, or other malicious code
- Engage in phishing, scamming, or fraudulent activities
- Attempt to gain unauthorized access to our systems
- Use the Service to send spam or unsolicited communications
- Resell or redistribute the Service without authorization
- Use the Service in any way that could damage, disable, or impair its functionality
5. AI-Generated Content
INSTROC uses artificial intelligence to help you create application content and code. You acknowledge that:
- AI-generated content may require review and modification
- You are responsible for reviewing and approving all content before publishing
- We do not guarantee the accuracy, completeness, or suitability of AI-generated content
- You retain ownership of the content you create using our AI tools
- You are solely responsible for ensuring your published applications comply with applicable laws
6. Intellectual Property
Your Content: You retain all rights to the content you create using INSTROC. By using our Service, you grant us a limited license to host, display, and distribute your content as necessary to provide the Service (including hosting your published applications).
Our Property: INSTROC, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of our Service.
7. Subscriptions, Credits, and Payments
INSTROC offers both free and paid plans:
7.1 Subscriptions
- Paid subscriptions are billed monthly or annually as selected at the time of purchase
- Subscriptions auto-renew unless cancelled before the renewal date
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period
- Payments are processed securely through Stripe. We do not store your full payment card details
7.2 Credits
- Credits are consumed when you use AI features (code generation, chat, error fixes) and certain platform features
- Each subscription plan includes a monthly credit allocation. Additional credits can be purchased as credit packs
- Monthly subscription credits reset at the start of each billing cycle. Unused monthly credits do not roll over
- Purchased credit packs do not expire as long as your account remains active
- Credits are non-transferable between accounts
7.3 Pricing Changes
We may change our pricing from time to time. Price changes for subscriptions take effect at the start of the next billing period after notice is given. We will notify you at least 30 days in advance of any price increase.
8. Refund Policy
We want you to be satisfied with INSTROC. Our refund policy is as follows:
- Subscriptions: You may cancel at any time. No refunds are provided for the current billing period, but you retain access until the period ends
- Credit packs (unused): If you have not used any credits from a purchased credit pack, you may request a full refund within 14 days of purchase
- Credit packs (partially used): If you have used some credits from a purchased pack, a refund may be issued for the unused portion at our discretion within 14 days of purchase
- Billing errors: If you were charged incorrectly, contact us and we will issue a full refund
By purchasing credits or beginning to use a paid subscription, you acknowledge that the digital service begins immediately upon purchase and you consent to the immediate performance of the service. To request a refund, contact support@instroc.com.
9. Service Availability
We strive to maintain high availability of our Service, but we do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or security reasons. We will make reasonable efforts to provide advance notice of planned downtime. We are not liable for any losses resulting from Service interruptions.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- INSTROC is provided "as is" and "as available" without warranties of any kind, either express or implied
- We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities
- Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for the content, functionality, or availability of third-party services integrated with the platform
Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold harmless INSTROC, its officers, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of: (a) your use of the Service; (b) content you create, publish, or distribute through the Service; (c) your violation of these Terms; or (d) your violation of any third-party rights.
12. Termination
You may close your account at any time through your account settings or by contacting support@instroc.com. We may suspend or terminate your account if you violate these Terms or engage in activities that harm our Service or other users.
Upon termination, your right to use the Service ceases immediately. You may export your content before closing your account. We will delete your personal data in accordance with our Privacy Policy. We may retain certain data as required by law or for legitimate business purposes.
13. Dispute Resolution
If you have a dispute with us, we encourage you to first contact us at support@instroc.com so we can try to resolve it informally. We commit to making a good-faith effort to resolve any dispute within 30 days.
If we cannot resolve the dispute informally, it shall be submitted to the competent courts of Sweden. Nothing in this section prevents you from filing a complaint with your local consumer protection authority or the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. If you are a consumer in the European Union, you also benefit from any mandatory provisions of the consumer protection laws in your country of residence.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via email or through the Service at least 30 days before they take effect. Your continued use of INSTROC after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you may close your account before they take effect.
